Terms of Service
Last updated: 8 September 2026
These Terms of Service ("Terms") constitute a binding legal agreement between you and Eversolve governing your access to and use of the Eversolve hosted contact widget, dashboard, forms, billing, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, Cookie Policy, and Cancellation and Refund Policy.
If you do not agree to these Terms, you must not access or use the Service.
1. Agreement and Eligibility
You represent and warrant that you have the legal capacity and authority to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction if higher, to create an account and use the Service.
The Service is offered from the United States. You are responsible for ensuring that your use of the Service complies with all laws applicable to you.
2. Service Description
Eversolve provides a hosted software service that enables website owners to consolidate contact channels, embed contact widgets, configure forms, collect submissions, manage domains, view plan-gated analytics, and related functionality through a web dashboard.
Eversolve may modify, suspend, or discontinue any part of the Service at any time, with or without notice, provided that Eversolve will use commercially reasonable efforts to provide advance notice of material adverse changes where practicable.
Certain features are available only on specified subscription plans. Feature availability, limits, and retention rules are described in the Service interface and documentation and may change from time to time.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You must promptly notify Eversolve at support@eversolve.io of any unauthorized access or use.
You agree to provide accurate, current, and complete account and business information and to keep such information updated.
You are solely responsible for your widgets, channels, forms, branding, domain configurations, webhook destinations, and all content and data you submit to or collect through the Service.
4. Acceptable Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any manner that violates applicable law, infringes intellectual property or privacy rights, or harms Eversolve, other users, or third parties.
Without limiting the foregoing, you agree not to use the Service to send, facilitate, or distribute spam, phishing, malware, fraudulent schemes, harassment, hate speech, illegal content, or deceptive practices.
You agree not to attempt to reverse engineer, decompile, disassemble, interfere with, disrupt, overload, or circumvent security, authentication, rate limits, or access controls of the Service.
You agree not to collect information from individuals without appropriate notice, consent, or other lawful basis as required by applicable law.
5. Prohibited Conduct
You may not use the Service to engage in conduct that is abusive, fraudulent, deceptive, defamatory, obscene, threatening, or otherwise objectionable in Eversolve's reasonable discretion.
You may not use the Service to distribute unsolicited commercial communications at scale or to harvest information in violation of applicable law or third-party terms.
You may not misrepresent your identity or affiliation, impersonate any person or entity, or create accounts through automated means except as expressly permitted by Eversolve.
Eversolve may investigate suspected violations and cooperate with law enforcement where appropriate.
6. Prohibited Data Categories
Unless Eversolve expressly authorizes a specific use in writing, you may not use the Service to collect, store, transmit, or process any of the following categories of information:
(a) protected health information or other information regulated as medical or health data under applicable law;
(b) government-issued identification numbers, passports, or similar government identity documents, except where a standard contact form field is used lawfully for a non-regulated purpose;
(c) payment card numbers, card verification values, bank account credentials, or similar financial access credentials;
(d) personal information of children under thirteen (13) years of age where collection is not permitted by applicable law;
(e) biometric templates or highly sensitive personal data not necessary for ordinary business contact purposes;
(f) passwords, authentication secrets, or credentials belonging to third parties;
(g) information you do not have a lawful right to collect or process; or
(h) information whose collection or processing would cause Eversolve to become subject to sector-specific regulatory regimes for which the Service is not designed.
You are solely responsible for determining whether your use case is appropriate for the Service and for obtaining all required notices and consents from individuals whose information you collect.
7. Visitor and Submission Data
When you use the Service to collect information from your website visitors or customers, you are responsible for your own privacy notices, consents, and compliance obligations with respect to those individuals.
Eversolve hosts and processes visitor submissions on your behalf solely to provide the Service. You grant Eversolve a limited license to host, store, process, display, export, and transmit such data as necessary to operate the Service in accordance with your configuration.
If you configure webhooks or other outbound integrations, you are responsible for the security, legality, and privacy practices of each destination endpoint. Eversolve transmits data to those endpoints only as directed by your configuration.
8. Billing and Subscriptions
Paid plans are billed in advance through a third-party payment processor at the monthly or annual interval you select. By subscribing, you authorize Eversolve and its payment processor to charge the payment method on file for applicable fees, taxes, and charges.
Fees are stated exclusive of taxes unless otherwise indicated. You are responsible for applicable taxes except those based on Eversolve's net income.
Eversolve may change pricing or plan features upon notice as provided in the Service or by email. Price changes apply to subsequent billing periods and do not retroactively affect a current paid term except as required by law.
9. Referral Program
Eversolve may offer a referral program that allows eligible account holders to earn account credit by referring new users to the Service. Participation is voluntary and subject to these Terms, the Privacy Policy, and the Cookie Policy. Eversolve may modify, suspend, or discontinue the referral program at any time, with or without notice, to the extent permitted by applicable law.
Each eligible account receives a unique referral link and referral code that may be shared with prospective users. Attribution is determined on a first-touch basis when a prospective user arrives through a referral link and is locked at account creation. A referred account may be attributed to only one referrer. Self-referrals, duplicate attributions, and attributions obtained through fraud, misrepresentation, or violation of these Terms are void.
Referral attribution may rely on first-party cookies or comparable browser mechanisms as described in the Cookie Policy. You are responsible for ensuring that your sharing and promotion of referral links complies with applicable law, including any disclosure obligations that apply to you.
When a referred user subscribes to a paid plan and completes payment, the referrer may earn referral credit equal to fifty percent (50%) of the amounts actually paid by the referred user on that payment, calculated on a per-invoice basis and rounded down to the nearest cent. No referral credit is earned on amounts that are not collected, including invoices fully covered by discounts, promotional credits, or existing account balance. Referral credit is earned only while the referral relationship is in an active earning state, as determined by Eversolve in the Service.
Referral rewards are issued solely as non-transferable account credit applied against future subscription invoices for the Service. Referral credit is not cash, is not a bank deposit or stored-value instrument, cannot be withdrawn or redeemed for cash, and cannot be assigned or transferred to another person or account. Account credit is applied automatically to eligible future invoices until exhausted. Account credit may reduce amounts due on renewal or other subscription charges but cannot create a negative cash balance or cash refund.
If a referred user downgrades to a free plan, cancels a paid subscription, or experiences a failed or reversed payment, the referral relationship may enter a paused state and no further referral credit will accrue until the referred user returns to a paid plan and the relationship resumes in accordance with program rules shown in the Service. Referral credit already earned and recorded in the referrer's account before a pause generally remains available, subject to these Terms.
If a referred user's payment is refunded or reversed through an external refund, chargeback, or payment dispute, Eversolve may reverse a proportional amount of referral credit previously issued in connection with that payment. Reversals are reflected in the referrer's account credit balance and credit history.
Referral credit accrued while an account is on a free plan is retained in the referrer's account and becomes applicable to future subscription invoices when the referrer subscribes to a paid plan, subject to program rules in the Service. Accounts on custom or non-recurring billing arrangements may contact support@eversolve.io regarding application of referral credit.
Upon permanent account deletion or other hard termination of a referrer's account as described in the Privacy Policy, any unused referral credit associated with that account is forfeited without compensation. Eversolve may investigate suspected referral abuse, withhold or reverse credits, suspend participation, or terminate accounts that engage in fraudulent, deceptive, or abusive referral activity.
The referral program does not create an employment, agency, partnership, or joint venture relationship between you and Eversolve. You have no authority to bind Eversolve or make representations on its behalf. Tax treatment of referral benefits, if any, is your sole responsibility.
10. Cancellation
You may cancel a paid subscription at any time through the billing interface. Cancellation is governed by the Cancellation and Refund Policy, which is incorporated into these Terms by reference.
Upon cancellation or expiration of a paid plan, your account may revert to a free plan and certain paid-only data or resources may become subject to downgrade retention and deletion rules described in the Privacy Policy.
11. Refunds
All subscription fees are non-refundable except as required by applicable law. The Cancellation and Refund Policy sets forth the complete refund and cancellation terms governing paid subscriptions and is incorporated into these Terms by reference.
For billing questions, contact support@eversolve.io.
12. Intellectual Property
Eversolve and its licensors retain all right, title, and interest in and to the Service, including all software, documentation, branding, and underlying technology. No rights are granted except as expressly set forth in these Terms.
You retain ownership of content and data you submit to the Service. You grant Eversolve a worldwide, non-exclusive, royalty-free license to use, host, reproduce, process, transmit, and display your content solely to provide, maintain, secure, and improve the Service.
You may not use Eversolve trademarks, logos, or branding except as expressly permitted in writing or through permitted powered-by branding features of the Service.
13. Feedback
If you provide suggestions, ideas, or feedback regarding the Service, you grant Eversolve a perpetual, irrevocable, worldwide, royalty-free license to use such feedback without restriction or compensation to you.
14. Third-Party Services
The Service may integrate with or rely upon third-party services, including payment processing, email delivery, security, hosting, and infrastructure providers. Your use of third-party services may be subject to separate terms imposed by those providers.
Eversolve is not responsible for third-party services, websites, or destinations you configure, including webhook endpoints.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
EVERSOLVE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT DATA WILL NOT BE LOST OR ALTERED.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL EVERSOLVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF EVERSOLVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVERSOLVE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO EVERSOLVE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, the foregoing limitations apply to the fullest extent permitted by law.
17. Indemnification
You will defend, indemnify, and hold harmless Eversolve and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your content or data, (c) your violation of these Terms or applicable law, or (d) any dispute between you and a third party, including individuals whose information you collect through the Service.
18. Termination
You may stop using the Service at any time. You may request account deletion through Settings, subject to the deletion grace period described in the Privacy Policy.
Eversolve may suspend or terminate your access to the Service immediately if you violate these Terms, create risk or legal exposure for Eversolve, fail to pay applicable fees, or if Eversolve reasonably believes suspension or termination is necessary to protect the Service or other users.
Upon termination, your right to access the Service ceases. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except to the extent preempted by applicable federal law.
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in such courts.
You and Eversolve waive any right to a jury trial to the extent such waiver may be made under applicable law.
20. Modifications to These Terms
Eversolve may modify these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date and, where appropriate, notified through the Service or by email. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by law.
21. General Provisions
These Terms, together with the Privacy Policy, Cookie Policy, and Cancellation and Refund Policy, constitute the entire agreement between you and Eversolve regarding the Service and supersede all prior or contemporaneous agreements on that subject.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
Eversolve's failure to enforce any provision is not a waiver of its right to do so later. You may not assign these Terms without Eversolve's prior written consent. Eversolve may assign these Terms in connection with a merger, acquisition, or sale of assets.
